It is a policy that covers loss of or damage to the goods in transit for import or export by sea, air and land. Loss or damage of cargo during inland transit within Thailand is also covered.

Institute Cargo Clauses for Marine Cargo policy

Institute Cargo Clauses (A)
This insurance covers all risks of loss of or damage to the subject-matter insured except as excluded.
 

Institute Cargo Clauses (B)

  1. Loss of or damage to the subject-matter insured reasonably attributable to
    • fire or explosion
    • vessel or craft being stranded grounded sunk or capsized
    • overturning or derailment of land conveyance
    • collision or contact of vessel craft or conveyance with any external object other than water
    • discharge of cargo at a port of distress
    • earthquake volcanic eruption or lightning

  2. loss of or damage to the subject-matter insured caused by
    • general average sacrifice
    • jettison or washing overboard
    • entry of sea lake or river water into vessel, craft, hold, conveyance container or place of storage

  3. total loss of any package lost overboard or dropped whilst loading on to, or unloading from, vessel or craft
  4. General Average

Inland Cargo Policy

Inland Cargo Policy (All Risks)

  1. Total or partial damage or loss of the subject matter insured arising from accident or external cause.
  2. General average in respect of the subject matter insured including general average contribution and salvage charges for which the assured has to compensate in accordance with customary practice or law unless excluded
     

Inland Cargo Policy (Named Perils)

This insurance shall cover total or partial damage or loss of the subject matter insured caused by:

  • Fire, explosion or lightning.
  • Collision or contact of the carrying conveyance or the subject matter insured with other conveyance or any object outside the conveyance including driver’s cab and platform or trailer of the carrying conveyance.
  • Sinking or grounding of vessel, falling of aircraft, train  derailment, overturning or falling of conveyance including its driver’s cab and platform or trailer from road, bridge or road shoulder.
  • Additional special risks clearly stipulated in the Schedule.

What we don't cover

Marine Cargo Policy

In no case shall this insurance cover:

  • Loss damage or expense attributable to wilful misconduct of the Assured 

  • Ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insured 

  • Loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured 

  • Loss damage or expense caused by inherent vice or nature of the subject-matter insured 

  • Loss damage or expense caused by delay, even though the delay be caused by a risk insured against 

  • Loss damage or expense caused by insolvency or financial default of the owners managers charterers or operators of the vessel where, at the time of loading of the subject-matter insured on board the vessel 

  • Loss damage or expense directly or indirectly caused by or arising from the use of any weapon or device employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter. 

  • Deliberate damage to or deliberate destruction of the subject-matter insured or any part thereof by the wrongful act of any person or persons shall excluded under ICC (B) and (ICC (C) 

  • In no case shall this insurance cover loss damage or expense arising from unseaworthiness of vessel or craft or unfitness of vessel or craft for the safe carriage of the subject-matter insured 

  • Loss damage or expense caused by war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power, capture seizure arrest restraint or detainment, and the consequences thereof or any attempt thereat, derelict mines torpedoes bombs or other derelict weapons of war. 

  • Loss damage or expense caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions, resulting from strikes, lock-outs, labour disturbances, riots or civil commotions, caused by any act of terrorism being an act of any person acting on behalf of, or in connection with, any organisation which carries out activities directed towards the overthrowing or influencing, by force or violence, of any government whether or not legally constituted, caused by any person acting from a political, ideological or religious motive. 
 
Inland Cargo Policy

In no case shall this insurance cover Loss or damage caused by or in consequence of:

  1. War whether declared or not, civil war, rebellion, revolution, coup d’état, insurrection, sabotage, riot, mutiny, popular uprising, declaration of martial law and use of government force sanctioned by law, land mines, torpedoes or any other weapons of war, strikes and lock outs.

  2. Deterioration or unfitness of conveyance for safe carriage, or overloading or towing that exceeds the capacity of the conveyance for safe carriage, or towing in the manner that violates the rules of safe carriage or stowing in the manner that violates the rules of stowage, if the assured, his employees or agents are privy to such condition at the time of delivery of the subject matter insured to the carrier.

  3. Loss or damage caused by

          (3.1) Ordinary deterioration or inherent vice or nature of the Subject-Matter Insured.

          (3.2) Ordinary leakage, ordinary wear and tear, ordinary loss in weight or volume of the subject matter insured

          (3.3) Insufficient or unsuitable packing, or preparation of shipping container by the Assured or his  employees

          (3.4) Delay in delivery howsoever caused including damages incurred from delay in delivery

          (3.5) Willful misconduct of any person to cause destruction or damage to conveyance or the subject matter insured

          (3.6) Willful misconduct of the Assured, or where the Assured is in privy to the misconduct of his employees to cause destruction or damage to conveyance used for the carriage or the Subject Matter Insured

          (3.7) Theft, snatching, robbery or gang robbery of the subject matter insured occurring at the point  of accident ensuing the covered risks                            

      4. Any damage or loss caused by or attributable to radiation, contamination by radioactivity from any nuclear fuel or from nuclear waste caused by combustion of nuclear fuel, fission or explosion of radioactivity or nuclear components or any hazardous property which may explode in the nuclear process

     5. General average, general average contribution and salvage charges.

     6. Any damage or loss occurred to the subject matter insured when the assured can recover or is entitled to indemnity under marine cargo policy or any other policy regardless of whether this policy was concluded before or after the other policy unless such damage or loss exceeds cover provided under such other policy in which case the remaining damage or loss shall be considered for cover in accordance with this policy.

     7. All consequential losses arising from damage to or loss of the subject matter insured, such as loss of market, interruption of business and production line, loss of use, etc.

Remark: Inland Cargo Policy (All Risks) shall not be excluded items 3.6 and 3.7 and 5
